Acceptance of Terms
By accessing or using Driven History at www.drivenhistory.com or the Driven History mobile app (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
The Service
Driven History is a personal automotive timeline platform. It allows registered users to record, organise, and share the history of vehicles they have owned, including photos, specifications, and personal notes.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.
User Accounts
To use most features you must create an account with a valid email address and password. You are responsible for:
- Keeping your password confidential and not sharing it with others.
- All activity that occurs under your account.
- Notifying us immediately at Valet@DrivenHistory.com if you suspect unauthorised access.
You must be at least 13 years old to create an account. Accounts created in violation of this requirement will be removed.
Your Content
You retain ownership of all content you submit to the Service — including car records, photos, descriptions, and any other data ("Your Content"). By submitting content you grant Driven History a non-exclusive, worldwide, royalty-free licence to store, display, and process Your Content solely to provide and improve the Service.
You represent and warrant that:
- You own or have the right to submit Your Content.
- Your Content does not infringe any third-party intellectual property, privacy, or other rights.
- Your Content does not contain unlawful, offensive, or harmful material.
We do not sell Your Content to third parties. See our Privacy Policy for full details on how data is handled.
AI-Powered Features
The Service includes AI-powered features such as automated car specification lookups, photo suggestions, and AI-generated images, provided via OpenAI.
- AI-generated content is provided for informational and creative purposes only. It may be inaccurate, incomplete, or not suitable for all purposes.
- You are responsible for verifying the accuracy of any AI-generated specifications or information before relying on it.
- AI-generated images are created based on your car data. We make no guarantees regarding the accuracy or quality of generated images.
Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Upload or transmit viruses, malware, or any code designed to disrupt or damage the Service.
- Attempt to gain unauthorised access to any part of the Service or its related systems.
- Scrape, crawl, or data-mine the Service without our prior written consent.
- Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
- Use the Service to send unsolicited communications (spam) to other users.
- Upload content that is defamatory, obscene, discriminatory, or otherwise objectionable.
Intellectual Property
All content, design, code, trademarks, and branding on the Service — excluding Your Content — are the property of Driven History or its licensors and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from Service content without our express written permission.
Third-Party Services & Links
The Service integrates with third-party providers (OpenAI, SerpAPI, Vercel, Neon, Resend) to deliver its features. Your use of these integrations is also subject to those providers' terms and privacy policies.
The Service may contain links to external websites. We are not responsible for the content or practices of any third-party sites.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Vehicle data and AI-generated content are provided for informational purposes and we make no representations as to their accuracy.
Limitation of Liability
To the fullest extent permitted by law, Driven History and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — even if advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $50.
Termination
We may suspend or terminate your account at our discretion if you breach these Terms or if we determine that your use of the Service is harmful to other users or to us.
You may delete your account at any time by contacting us at Valet@DrivenHistory.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page and updating the "Last updated" date. For material changes we will make reasonable efforts to notify you (for example, via email). Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
